Federal Poverty Guidelines

For certain government programs, eligibility is dependent on meeting income limits which are based on the Federal Poverty Guidelines.   Each year, the Guidelines are published in the Federal Register by the Department of Health and Human Services ("HHS").   The Guidelines are used to establish income limits for needs-based programs, such as Medicaid and Jersey Assistance for Community Caregiving ("JACC"). The Guidelines are also used by the U.S. Citizenship and Immigration Services ("USCIS") to determine financial eligibility to sponsor an immigrant for a Permanent Resident Visa.

  1. In accordance with Section 1012 of the Department of Defense Appropriations Act of 2010, the poverty guidelines published on January 23, 2009 remained in effect until updated poverty guidelines were published in August 2010.

  3. The 2011 HHS Poverty Guidelines were published in the Federal Register, Vol. 76, No. 13, January 20, 2011, pp. 3637-3638.
  4. The 2012 HHS Poverty Guidelines were published in the Federal Register, Vol. 77, No. 17, January 26, 2012, pp. 4034-4035.
  5. The HHS Poverty Guidelines may be formally referenced as "the poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2)."
